    The 22-year-old man killed by a BART police officer early New Year's Day was lying face-down on the train platform, his hands behind him waiting to be cuffed, when he was shot in the back, a lawyer newly hired by the man's family said Saturday.

    Yet another reason police should be the only people to "have" guns.

    Another interesting fact is that these 5 people were being detained as witnesses.

    What's funny is, the guy shoots him in the back, and all the people can do is run away.

    Yea lets riot when this guy just shot someone in the back while he was lying down. They rioted after they felt they weren't going to get shot. Here is an article about it.

    This made me sick to my stomach, and I'm not even saying that figuratively.

    I am livid.

    This fat bureaucrat gets to go home, and not think about it at all.

    The cops had no right to detain those people, man. Much less to point any guns at them, regardless of whether or not the pulling of the trigger was intentional or not. If a private citizen so much as aims a weapon at another person, it's a serious crime.

    Yea, it would have been better if everyone involved had guns, then they could have had a gun fight with the cops, which would have been a better outcome.

    I mean...you simply cannot justify shooting a handcuffed person in the back like that. If nothing happens, if nothing gets done to punish the cops involved then I do hope the shit does hit the fan, people cannot stand for that.

    Saw this video a few days ago. I'm glad technology has evolved to the point when we can capture such atrocities on camera.

    However, there is not a doubt in my mind that this cop is going to get off.

    I don't see how anyone having a gun would've benefited this situation. Alright, it shows that some cops are either morons or evil bastards, but that really does nothing for the gun debate.

    More gun would not have helped. Plus Im willing to bet all of those people were wasted.

    But yea, I dont see why they are saying how was laying there cooperation, he was struggling, you can see it. But shooting him in the back? Thats ridiculous. Looks to me like he went to draw on him and had a A.D. Which is still no excuse to murder someone. Just because it was an accident doesnt mean you can get off scott free.

    I don't know if it was an accident or not, it kind of seems like it but I don't know. I hope he goes to jail for a long time, he should be treated just like a normal person and hopefully to the fullest extent of the law.

    Which is an idiotic assessment of anti-gun positions. Both sides of the debate pro and anti-gun recognize that police are not perfect.

    How this particular incident has any bearing on the gun debate is beyond me, unless you propose this situation would have been better if police are disarmed, or if the people in custody were armed.

    So from what Ive been reading, people think the cop may have thought the gun was his taser. Cause he drew, and shot 3 seconds later.

    And the frame of a taser and a Glock are very similar, and with all that adrenaline pumping, it would be hard to tell teh difference that quick by touch alone. Thats why most officers keep their gun on their strong side and the tazer on the weak side and cross draw.

    But he is probably going to get something like manslaughter.
